WARRANTY
Any warranty, which must be confirmed in writing by Dahil Corporation in order to be valid, is limited to faulty materials or workmanship and not as a consequence of fair wear and tear which is excluded in its entirety and only then to that proportion of the unused life expectancy as decided by Dahil at its sole discretion. In the absence of anything in writing to the contrary, claims must be notified to us in writing within 6 months of shipment at the Korean port or 3000 feet, whichever comes first. Dahil reserve the right to refuse claims of any nature, arising from any item which has not been properly operated or maintained, in particular but not limited to any product which
- has been subjected to excessive thrust(feed force), rotational torque or
rotation speed.
- has been operated outside its designated air pressure working range.
- has suffered insufficient or incorrect lubrication or routine maintenance.
- has been fitted with any parts not of Dahil supply.
- has been abused, neglected or subjected to wanton damage,
in particular but not limited to the application of heat, weld or direct
impact to DTH hammer components.
- has not, where Dahil has so requested, been returned for inspection in
its entirety.
With particular respect to DTH button bits, any button bit which
- has not been reground at necessary intervals commensurate with the
nature of
the rock being drilled.
- in the case of oversize drill bit diameters as defined in Dahil¡¯s catalogues,
have been used in conditions unsuited to their use and/or where shank failure
has occurred.
- has suffered breakage of only one single button.
Credit against warranty claims will be granted, if proved valid, and will be
paid on
the basis of the Ex-works Korea price of the goods as sold. Such credit will
exclude
items considered as consequential loss, in particular but not limited to
packing,
carriage charges, import duties, sales tax, retail profit etc. Dahil however
retains
the right to supply replacement goods instead at its sole discretion.
